General Data Protection Regulation Compliance for Nonprofit Organizations

The General Data Protection Regulation (GDPR) goes into effect May 25, 2018. Although this a European Union (EU) regulation, it affects all organizations that collect personal data of EU citizens.

We recommend that all nonprofit organizations follow the regulation’s guidelines for data and privacy protection and verify that they have the necessary policies and procedures in place to comply.

The GDPR includes requirements for Accountability and Governance to ensure your constituent's data is secure and protected. Most organizations already have data security measures in place to prevent data breaches and other unauthorized access. Following the GDPR Guidelines may impose additional assessment, documentation and management requirements your organization has not yet considered.

The GDPR also includes requirements that you have a documented legal right to use the data you collect in your business processes. A nonprofit organization needs to have a legitimate business interest in using the data or obtain the constituent's consent to use their data.

Finally, the GDPR includes rights for individuals that require your organization to have processes in place to manage.

December 1st is Giving Tuesday, the international day of giving founded in 2012 by the 92nd Street Y in New York City.  Since then, it has been held annually on the Tuesday immediately following the U.S. day of Thanksgiving.

Giving Tuesday has evolved to include thousands of nonprofits from around the world.  Many of them, including several of Agilon's clients, include higher education organizations.
